Property rights are not included in the Canadian Charter of Rights and Freedoms. There is no guarantee of compensation for property taken by government and there is no guarantee of fair procedure.

Property rights are included in the Bill of Rights, but because the Bill of Rights is a federal statute that can be overridden by the Charter, this protection is not enough. Property rights need to be written into the Charter of Rights and Freedoms to have the protection of the courts.
